Understanding ACTA

The opposition against ACTA if finally getting some momentum, but it seems most of the critique focuses on its impact on the internet. While this is an important aspect this is buy no means the only problem with ACTA.

In order to really understand ACTA we need to look at the economic side of it. Who would profit from its implementation? This is, we should look at it from a marxist point of view [1].

How Capitalism Works

Capitalist society works by exploiting social relations, or more precisely social difference. One class holds the means of production (= owns the factories) and another class has nothing more then to sell their labor power in order to survive. Capitalists compete with one another on the market and thus they are driven to make there products as cheep as possible. So they will not be able to pay their workers much more then they need to survice (or else they risk to go out of bussiness). This setting takes care that this social relation stays the way it was: The working class will stay poor and the capitalist will get richer.

Higher Profits through Outsourcing

Now the less the capitalist has to pay to the worker the higher his/her profit. So outsourcing production to countries with a lower level of wages brings higher profits. (And the competition on the market ensures that those who do not make use of this will go out of business).

But there is a problem here. Unlike in the setting above it is much more likely that the outsourced production will create new competition: Lets say a few people who used to work in one of the sweatshops decide to take matters into their own hand. They get some sponsoring (maybe from local capitalists or the local government) to build up a factory that produces on their own and tries to directly market their products without the intermediary.

Keep up the Difference

So in order to keep up the wage difference and to keep up the profits the capitalist needs some way to ensure that know-how of the production does not disseminate and also to prevent the access to the markets for the new competitors. This is where trade agreements like ACTA come into play.

While dissemination of knowledge can not be easily stopped, these so called “Intellectual Property” laws can at least make it illegal to use.

Why ACTA is bad

From the analysis of the last paragraph it is already easy to understand why ACTA is bad:

The better the protection of the so called “Intellectual Property” there more there is motivation for outsourcing: How ACTA kills your job
The better the restriction of trade works the easier it is to keep the poor countries poor while exploiting them.

Each year about 10 Million people have to starve even thought there would be enough food to feed everyone on this planet. Buy keeping the poor countries poor this treaty will be responsible for this continued killing . A disgrace to mankind.

here is a scientific study that analysis the effect of ACTA on poor nations. It labels it as “Collateral Damage”. But from the marxist point of view we see that this damage is not “collateral” at all: Keeping the poor stay poor is the first and foremost intention of ACTA!

A lot of people point out how ACTA will impact ACTA the access to medicines in developing countries, but it is not just medicine. It is knowledge, technology, food, clothes, houses,... What kind of right do we have to deprive these people from the access to anything?

But lets take a look at

the History of ACTA

First: the rich nations (which are all under regimes that are completely corruped and bribed by big corporations tried to impose their IP-regime through the WTO-TRIPS negotiations onto the poorer countries. This worked for a while but soon the developing countries recognized that it was not in their interest to be forced to pay licensing fees to access know-ledge that could otherwise be free and beneficial to all mankind. So the negotiations for TRIPS+ (the successor of TRIPS) got stuck. The tactics of backroom deals and bullying did no longer work. This is was the moment when the richer nations decided that they had to start enforcing their IP-Regime against without the consent of the oppressed. This is when the ACTA negotiations started.

This is a really bad precedent! We must never allow the rich countries to design and implement global rules against the will of the poorer countries! The only possible answer to ACTA is an international solidarity!

Policy Laundering

Now no one is surprised that they tried to have the negotiations of this treaty that runs completely against all public interests where held in complete secrecy and we where only informed by the negotiations due to leaked documents.

In this, ACTA is a perfect example of Policy laundering: Countries negotiate important rules on an international level. Then they bring those rules home and pretend that this was the best “possible compromise” and that they are not happy with it but they have to sign it anyway. This way national parliaments and other democratic institutions are bypassed.

So if we allow the ruling elites to get this through then they will continue this strategy to further bypass our parliaments. It is important here to notice: In order to avoid the mechanism of policy laundering it is not enough that the finial documents is made public after a negotiation in secrecy: It is necessary that every step of the negotiation is made public: Who demands what and why? (Else everyone will blame that the bad parts of the treaty where demanded by the other side).

In a democratic society, if we want to hold our elected representatives accountable for what they do, we must not allow any treaty that was negotiated in secrecy!

Some interesting observations

Have you ever noticed how horrible slow the international negotiations are when it comes to protecting our environment, reduce greenhouse gases, closing down tax havens, establishing minimum standards for labor rights or find some decent measures to solve the financial crisis? They go from one summit to the next and all they have for us is hot air. But when it comes to negotiate something such highly controversial like this there is suddenly no problem and within just a few years they have a treaty ready for signing!

This is one of the points where we can see how deeply corrupted our political system is. As long as it helps the maintain the profit of the 1% all the world leaders, wether social democrats [2], conservatives, democrats or republicans they are all in for it.

To Sum it up: why we have to stop ACTA

ACTA will destroy the freedom of the internet
ACTA will keep the poor countries poor and thus will kill people. (10 Million/year already starving)
ACTA will promote outsourcing and offshoring: it kills your job
ACTA was negotiated without and against the less developed countries. We must not allow a precedent for such kind of negotiations. Global trade must not be regulated against the will of the smaller countries.
ACTA was negotiated in secrecy. We must now allow this kind of policy laundering.

The Crisis of Capitalism and How to Solve it

In order to solve the crisis we need to understand its nature first.

When we talk about crisis today, most people think of the “financial crisis” and often forget about the fact that there is an even bigger problem: the destruction of our environment, global warming and the exhaustion of fossil fuels and other sources, etc. Since these problems are in fact tightly connected, lets start with the so called “financial crisis”:

A lot has been said about how the banks and how the financial system is the problem. Often people even accuse the managers of those banks and and complain about their perceived “lack of moral” and about their “greed”, etc... But the problem is not some individual wrong doing. The problem is the system itself. And it is not just the financial system: It is first and foremost the real economy.

The current crisis, like so many before, is a crisis of overproduction. Well in the age of “just-in time” production there is not a direct abundance of goods but the production capacities are much higher then the demand.

Thanks to the technological and scientific developments our productive forces are now on a level where, with very little human afford we can produce much more then we can consume. So the shelves on the supermarkets are filled with crap that no one wants. Who need HD-3D-TV? Is there anyone who really uses the video-telephony features?

And there is an additional problem with the capitalist system: The intrinsic need for growth: Most of the profit that has been made by exploiting workers and nature needs to be reinvested. If one invest € 100 he wants to make 120 within some period of time and from there he wants 144, and so on.

In order to invest these money new industries need to be built. But since the markets were already saturated there was not much opportunity to invest into real economy. But actually most capitalists did not worry much about this problem. They brought there profits to the bank and wanted them to invest it where ever they thought it would be profitable. Due to the lack of real companies that would build useful goods and services the banks simply invented some “virtual” investment opportunities. As anyone with a basic marxist education know: Value can only be derived by exploiting labor and nature. So it was clear that all the profits that these financial constructions where making where only fake and that the scheme would have to collapse sooner or later.

Now are not there any real opportunities for investment left? Well in former centuries the surplus money would often be invested into expansion into other regions of the world: Colonialist and imperialist exploitation of other countries. But today almost the whole globe is under the capitalist regime so there is not much room for expansion left. So in the last decades capitalism tried some “inward” expansion: Bringing parts of our life under capitalist control that where not dominated by it before. E.g.: the leasure and tourism industry or the attempt to exploit our human relations via social networking sites, so called “intellectual property”, etc, ... But there is a limit to that kind of “inward” expansion as well.

One other opportunity for investment is when an artificial demand for products is generated by the destruction of existing goods: E.g. war, advertizement, environmental damage. At least with war and environmental damage the potential for growth is still there: As long as we destroy enough there is always a need to rebuild it. Unlike the advertizement for the HD-3D-flat TV, if basic necessities of life are destroyed there is a real need for rebuilding them.

It is rather likely that some capitalists will see war as the easiest way for making some cheap money. Fortunately the capitalist world of today is also highly interconnected so that war is not as likely in the “developed” nations. What we can see today are wars that are fought in less developed nations, preferable those where a lot of oil and other natural resources can be found.

Now there is one possibility for left for expansion: There are about 3 billion people who have to live on 2$ or less and about 10 million starving each year. There would be plenty of room left to deliver goods and services to those. But unfortunately the capitalist system does not see them as consumers as they have no money. So capitalism will rather let them starve then giving them some of our abundance of our products and services.

So we see: Our 2 problems: the “financial crisis” and the environmental destruction have the same root: the need for growth that is inherent to the capitalist system.

So after all these analysis it should not be very hard to draft a plan for mastering the crisis, shouldn't it?

Well the short and easy answer would be of course: abolish the capitalist system. But this would only provoke just more questions: How to abolish and and moreover: what system should replace it.

But before we derive some solutions lets first look at some of the usual solutions that people find that are simple stupid and wrong:

The “greedy banksters” are the problem. This is wrong in 2 ways: first: when we focus on things like “greed” then the problem is formulated as a moral problem. If this would be the problem then the solution would be to demand some “moral purification”, ethical codes for doing business , etc, etc.. As we can see from above: If the inherent growth is the problem, then any ethical rules will not help. In the best case it might just help to mitigate the problems, in the worst case the “smooth” growth will just leas us to banging into the next crisis even faster. The second thing that is wrong with the “greedy banksters” hypothesis is that there is the focus on the banks. And this leads to ignoring the “real economy”. But the banks to not blow the carbon dioxide into our atmosphere and neither do they produce much of the profits: the profits come from the exploitation of labor and nature. This is mostly done in the real economy.

Now some words about another wrong solution: The redistribution of wealth. Well, it is not that wrong. Sure we need a different distribution of wealth: there are 10 million people dying this year because they can not afford food and medicine, etc.. But there are 2 problem when we focus too much on the “redistribution of wealth” issue: first: When we redistribute wealth but do not change the system we would not solve much of our problems at all. We would still have inherent growth and the crisis that come with it and the destruction of our environment. And there is another problem with the the focus on “redistribution of wealth”: it suggest that these is a zero-sum game: that we need to take form the rich in order to give to the poor. And this creates some resistance among the rich: they think we want to take what they think belongs to them. But changing the system is not a zero-sum game: We all have something to gain: When we do not destroy our environment it is better for all of us, even for the rich. When we stop doing unnecessary work that has no real benefit for mankind (war, advertizement, etc..) and focus only on the work that is productive we could all gain enormous amounts of free time to spend with friends and family or some leisure. Well ok: the rich already have that time since they can earn money without working but then we all could gain that privilege to some degree. So there would be much to gain for everyone even without much redistribution.

The luxury life of the rich creates some carbon footprint but otherwise has the advantage that all the money that they spend on consumption does not get re-invested and thus at least does not contribute to the destructive growth.

The problem with the wealth of the rich is where they invest it into the economy: This causes the need for growth and allows them to command others without having any democratic legitimation to do so.

Okay, back to our solution: Instead of painting some far fetched utopia lets think about some steps that would bring is to the right direction:

Since there is an overproduction we need to work less. We need strong laws that would limit the weekly work hour and the lifetime work (e.g. by reducing the age of retirement, etc..). We produce so much crap that we do not need. If we would limit the time that one is allowed to work then the capitalists would have to restrict their production to what people really need. Of course this is unpopular among the members of the capitalist class because limiting the time of labor limits the profit in the exploitation. But this is what we want: less profit - less growth - less crisis. And with less work there comes less wasting or resources. So this solves both problems at once. Of course people will pretend that this is not possible: because it creates an incentive for capital to move the production to places where there is no strict limitation of working hours. Yes: this is a problem: So the reduction needs to be made on a global scale and in a coordinated way. the G20 could easily do it if they wanted. (Hey the make a lot of unpopular decessions - e.g. the ACTA - why not do something that makes sense? This would be an extremely easy solution - if it where not for the fact that the ruling class in the G20 have bought our political system and the people in power are either idiots or are corrupted or both.

We need a basic income: This also help reduce the motivation for work and it helps to reduce the dreadful growth. It give people some economic freedom to do what they really want: and this is often much more helpful then the crap that the capitalists command them to produce. E.g: Think about what the free software movement has accomplished, or wikipedia, etc.. How much more good things could be created if people had more economic freedom to do useful things? And when some capitalist still wants you to work for him then he needs to pay higher wages. So this also cuts into profits and thus again reduced the dreadful growth.

Millions of people are starving each year. So we really need some redistribution of wealth. Maybe in the form of a global basic income. The poorest would profit most from this. While this would lead to some growth in the less “developed” this growth would not be an exponential one and with the basic income it would also be a healthy growth: people could use their newly gained economic freedom there as well to produce useful things. Once they would reach the same standards of living as we have in the richer countries there would not be any more need for growth. While some people think that our planet has not enough resources for all to live a good life: If we stop producing all these useless crap that we produce now and focus on the important things in life then there would be no problem.

While a significant reduction of working hours would already give a lot of motivation to stop producing unnecessary crap, there is also a need to restructure the rules of our society that give motivation for producing this crap in the first place.

So called “intellectual property rights” are a good example of how absurd the capitalist system really is: Capitalism can only trade what is rare. But knowledge and information can, today, be reproduced almost without cost. So in order to keep this rare the capitalist system has create an arbitrary scarcity of these goods. This is done by copyright, patents and other so called “intellectual property” laws. While those laws are not new we see an aggressive extension of these laws, driven by the industries that would otherwise be completely obsolete as they are not producing anything useful. So we would need to change that rules and drop the artificial monopolies that we grant to those companies today.

An other big waste of resources is advertizement. Not only is it not useful but it is extremely harmful: Advertizement create artificial demand. It is here to create dissatisfaction with your life and suggest that you need to buy more products in order to be happy again. Thus advertisement drives the dreadful growth. But there is no need to ban advertizement: All that would be needed would be to relax trademark protection. Without trademark protection a lot of advertizement would become useless: No Logo!

So in theory the solution would be simple. Nothing that the leaders of the G20 could not decide to do if they wanted to. Starting with some reduction of the working week and some form of basic income and some changes in IP law.

But what we are seeing is that we are going in the complete opposite direction: Instead of reducing the working hour those people install austerity-programs. Instead of reducing IP law we have ACTA and now SOPA, etc..

So either these politicians are idiots or they are corrupt, or both. Well our whole political system is deeply corrupted. Up to the point where most of the corruption has been made legal by these people.

So while the solution could be so simple it seems it is not. So the first thing to do should be do (re-)install some form of democracy.

Fekter und die verkürzte Kapitalismuskritik

Maria Fekter (rechtsaussen in der ÖVP) hat angst davor dass wir in Europa Feindbilder “gegen die Reichen” und “gegen die Banker” aufbauen. Die Empörung über ihre Aussage ist groß und durchaus berechtigt. Aber eine leider aus den falschen Günden.

Hier die Aussagen der ex Innenministerin Empörung über Fekters Vergleich zwischen Juden und Reichenverfolgung (Der Standard) Und auch auf (YouTube).

Womit Fekter recht hat: Angesichts der Krisen des Kapitalismus wird heute immer mehr Menschen klar, dass da etwas nicht stimmen kann. Aber anstatt das System an sich zu kritisieren werden Sündenböcke gesucht. Nicht das System wird kritisiert sondern einzelnen Personen wird auf eine moralisierende Weise die Schuld in die Schuhe geschoben.

Und, da hat Fekter tatsächlich recht, das hatten wir schon mal. Auch die “Kapitalismuskritik” der Nazis orientierte sich an diesem Schema: Gegen das “Finanzkapital” (In der Nazidiktion das das “raffende” Kapital) dem die “gute” Realwirtschaft (Nazidiktion: das “schaffende” Kapital) gegenübergestellt wurde. Und wo diese art der verkürtzen Kapitalismuskritik geendet hat wissen wir heute alle.

Ja, es wäre durchaus wünschenswert diese art der Kapitalismuskritik kritischer zu betrachten. Eben weil zu erwarten ist dass mit den zunehmenden Krisen dieses Systems diese art der Kritik weitere Verbreitung findet.

Klar ist aber dass es völlig unakzeptabel ist mit dem Hinweis auf die Gefahren einer verkürzten Kapitalismuskritik die Kapitalismuskritik insgesamt delegitimieren zu wollen so wie das Maria Fekter tut. Dass es Fekter nicht darum kümmert dass irgendwo Feindbilder aufgebaut werden ist ja ohnehin klar. Das hat sie mit ihrer verhetzenden und rassistischen Politik als Innenministerin schon hinlänglich bewiesen.

Ein recht sich über verkürzte Kapitalismuskritik zu beschwern hat nur wer sich um tiefgreifende und scharfe Kritik des Sytems bemüht. Etwas das wir von Fekter (Mitglied einer Partie die den neoliberalen Kapitalismus vorantreibt wie kaum einer andere) sicher nicht erwarten werden.

Oder, wie Max Horkheimer sagte: “Wer aber vom Kapitalismus nicht reden will, sollte auch vom Faschismus schweigen”.

ACTA - How to kill Babies for Fun and Profit

Initially I wanted to write a short analysis of this study. But just skimming over the study shows that is a blatant pro IP propaganda piece. Still interesting to dissect that a bit.

The Study (pdf) starts with the following statement:

“The Anti-Counterfeiting Trade Agreement (ACTA) is motivated by the perceived lack of progress of multilateral enforcement of intellectual property rights.”

Ok. How to translate that: the “the perceived lack of progress of multilateral enforcement of intellectual property” means that some people are unhappy that the WTO did not manage to upgrade the insane TRIPS to a TRIPS+ agreement. Why did this happen? The answer is easy: The developing countries sooner or later found out that it does not help them much to pay huge licensing bills to the more developed countries just to be allowed to use newer technology. They realized that this would cost them a lot of money for nothing. On the other side where the big corporations who secured hundreds of thousands of patents and other so called “Intellectual Property” Rights that would have loved to see this money in their balance sheet. And thus this corporations would ask the political parties in the developed countries to do something about it.

Now, it happened that the interests of those political parties where somewhere aligned with the interest of those corporations. (Maybe there where some kind of financial bonds between them or something.). Now those parties which governed the G8 countries where happy to comply with the requests of these corporations and found some ways around the “problem”: If the poorer countries are not willing to comply with our IP regime then we will just ignore them and enforce those regulations anyway.

According to UN there are about 900 Million hungry people worldwide. About 6 Million Children are starving each year. Most of them of course in the least developed countries. Now those countries have rejected the TRIPS+ regulations out of some good reason. Further enforcing those absurd IP regulations would cost them money. And this of course would mean: More hungry children. More children starving.

It is that simple.

So this is what is ACTA all about: Killing Babies for Profit. Or to repeat it, as the euphemism of the EP study reads:

“The Anti-Counterfeiting Trade Agreement (ACTA) is motivated by the perceived lack of progress of multilateral enforcement of intellectual property rights.”

Now to the point about the blatant propaganda of the "study":

“Today, there is growing statistical evidence suggesting that a stronger environment of IPRs contributes to an enhanced level of economic development, FDI and technology transfer in developing countries. Based on the most comprehensive empirical research to date, an OECD study of the relationship between IPRs, technology transfer and FDI in 115 countries found that in developed countries an increase of 1% in the strength of patent rights resulted in 0.5% of increase in FDI flow (based on licensing deals), which in turn resulted in the transfer of know- how, i.e. innovative capabilities.139 The study found that in developing countries, including least developed countries, the effect is even stronger so that an increase of 1% in the strength of patent rights could be associated with an increase of 1.7% in FDI flows.”

Or to translate that into plain english: “Hey, everyone is accousing us of killing babies. We need to do something about that. Lets find some numbers that would help us to prove that we are not killing that babies. Numbers. Any numbers. How far fetched. It does not matter. Killing babies for profit that would be a PR disaster. We need to avoid that. Just give us numbers. Any numbers.”

Now here is the long form. Why is the study totally wrong:

1.) Correlation does not imply causation: Countries with a neoliberal agenda are likely to also implement stronger IPR. After all this is what helps the rich get richer. And countries with that neoliberal agenda are likely to also be attract foreign investments. After all: Who does not want a chance to make some quick money?

2.) Now there is some correlation between foreign investments and IPR regulations: A company is motivated to build up sweat shops in countries that have some rules to ensure that those who work in these shops even if they gain some know-how there will never be able to use this knowledge for them self and might produce similar things on their own and maybe cutting into the profits of that corporations. So a strong IPR rules that “protects” the neocolonial slave labor are indeed in the interest of foreign investors. This helps to “stabilize” the difference between rich and poor. The rich will get richer and the poor will stay poor. Ergo: More dead babies in the long run.

Wikileaks - The End of the World as We Know it

So what is it all about?

The first thing to realize is that the power of the leaks is not in the individual document. The important message is this: Nothing can be kept a secret anymore. Sooner or later most things will be revealed to the public. This is what frightens the global elite.

Because their power is based to a large degree on secrecy. „If you have nothing to hide, you have everything to fear“ - This is what they have been telling us all day long when they invaded our privacy, when they installed those security cameras, those airport scanners, those data retention laws, etc...etc.. „If you have nothing to hide, you have everything to fear“ - But those in power usually have a lot to hide. Why? Because their interests are to some degree opposed to our interests.

Wikileaks will make the world a better place

Next time a CEO, a Banker, a chief diplomat or a politician is about to fuck us he/she will think twice: is it really worth the trouble if this gets public? Am I 100% shore this can be concealed long enough? Etc. Just the Existence of something like WikiLeaks will make the world a better place.

There are those that fear that the Leaks might endanger people. True: but 100 times more it will prevent evils. If those in power can not be sure anymore that they get through with their shit they will think twice before doing it.

Transparency: Necessary for Democracy

There is a lot of talking today about the so called „post democracy“: While we live in a system that pretends to be democratic, the people have less power today to influence politics. There are many factors for this erosion of democracy, but one particular aspect is that today it is hard to spot someone who is responsible for what happens. In the jungle of international relations that for the backbone of our legislative process today it is hard to find out who is fucking with us. Look for the secret ACTA (Anti-Counterfeiting Trade Agreement). Who could say: this or that political party was to blame for some particular bullshit that will be imposed on us by this treaty? And if this feedback is missing then the voters can no longer react with their vote:

Transparency is a necessary precondition for democracy!

Counterbalance to the growing dangers of surveillance

Given the unprecedented ways that technology enables those in power to spy on us. Something the secret services of the past could have only dreamed of there is a growing imbalance of power. They know all about us but we do not know much about them. But they leave their digital trails as well and with sites like WikiLeaks their wrongdoing can be exposed as well. So we need a lot of sites like Wikileaks and a lot of people with the courage to leak to it, in order to counter balance the growing dangers of a 1984 like surveillance state.

This is not against the US

Some on the „left“ have applauded the recent Leaks because of their anti-US prejudice. While this kind of stupid, reactionary positions just shows their short sightedness it is sad to see that US-officials and and the media share this stupid position. Wikileaks was founded by Chinese dissistents and has already leaked information from all over the world. Even the recent cablegate leaks are not a strike against the US: The message is: If even a superpower like the US can not keep those kinds of secrets then no one can: Thus this potential evil doers all over the world now will start to think twice: Will it be possible to keep it secret? This way, the leaks help to protect us all over the world from any kind of evil government and evil corporations. For those who have read Hardt & Negri: This is not against the US. It is against the Empire.

While Wikileaks and similar sites will lead to more transparency and less evil doing in this world, will it be enough to bring real change? Will it be the nail in the coffin of neo-liberal capitalism?

They will fight it

While it prevent a lot of new evil from happening, a lot of those hat are still in power have much to loose: There already is a large track of their mischief. So we should expect that the ruling class will fight this as much as they can. We already see this happening....

Generation Change

The next thing we will is a Generation change: If the bourgeois wants to retain power they need to change the political (and administrative) personal: Younger people who do not have a long history with leakable material.

Ultimately: Can there be a fully transparent Capitalism?

Back then when the bourgeois discussed if they could accept democracy people where sceptical: Who would ever win an election but the workers party? Today we know that capitalists managed to keep in power despite the fact that their interests run contrary to the interests of the majority of people. Capitalism is an extremely versatile system: It manages to adopt to threats, incorporate its enemies and when it does it only makes the system stronger.

My Guess?: Under normal circumstances maybe capitalism could adopt to these circumstances. But today the system is already tumbling: More and more people are realizing that capitalisms inherent need for growth will clash with the limited resources of our planet. And since least since the last crash of the markets even the most vivid supporters of capitalism are starting to ask questions.....

So yes: In this situation the transparency that WikiLeaks brings has the power to change the whole system.

Für eine Ausweitung des NS-Verbotsgesetzes

Fast 65 Jahre lang gibt es in Österreich inzwischen ein NS-Verbotsgesetz. Leider hat aber die Geschichte gezeigt dass dies zu wenig wirkungsvoll ist: Noch immer gibt es hier Rechtsextreme Parteien die gegen MigrantInnen hetzen, NS-Verbrechen verharmlosen oder relativieren, Nationalismus schüren und mehr oder weniger offenen Antisemitismus zur schau stellen.

In der kleinformatigen Hetzblättern mit Millionenauflage die täglich jegliche Art von Chauvinismus, Nationalismus und Rassismus schürt, werden zum Hitlergeburtstag mehr oder weniger gut verklausulierte Glückwünsche abgedruckt ohne dass ein Staatsanwalt einschreitet.

Rechtextreme dürfen ganz offiziell in der Hofburg einen Ball feiern während die Demonstration dagegen mit brutaler Polizeigewalt niedergeknüppelt werden. [1] [2] [3] Wir schreiben das Jahr 2010.

Andreas Mölzer wurde niemals für die in seinem rechtsextremen Hetzblatt „Zur Zeit“ verübte Wiederbetätigung verurteilt weil ihm nicht nachgewiesen werden konnte, dass er den entsprechenden Artikel vor der veröffentlichung konnte. Das, obwohl er Herausgeber und Chefredakteur dieser Zeitung war. Nach wie vor bekommt er öffentliche Förderungen für diesen Unrat. [4] [5].

Umfragen zufolge sind antisemitische Stereotype noch bei über 45% der ÖstereicherInnen verbreitet. [6]

Es ist offensichtlich, dass das NS-Verbotsgesetz noch zu wenig Möglichkeiten bietet um gegen die Verbreitung rechtsextremen Gedankengutes vorzugehen. Das Verbotsgesetz in der heutigen Form und Auslegung reicht um öffentliche Heil-Hitler Rufe hintanzuhalten aber nicht um wirksam gegen alte und neue RechtsextremistInnen vorgehen zu können.

David Irving wurde verurteilt, aber die rechtsextreme Burschenschaft Olympia ist weiterhin unbehelligt und eines der Mitglieder hat es in diesem Lande bis zum Nationalratspräsidenten gebracht.

Natürlich ist klar, dass ein Verbotsgesetz alleine zuwenig ist um den Rechtsextremismus wirksam zu bekämpfen. Es bedarf hier auch einer breiten Initiative zur Förderung Antifaschistischer und Antirassistischer Bildung, Forschung und Öffentlichkeitsarbeit.

Andererseits könnte durch eine Ausweitung des NS-Verbotsgesetzes zumindest verhindert werden, dass weiterhin Presse- und Parteienförderung in den braunen Sumpf fließen.

Wie könnte eine entsprechende Verbesserung des NS-Verbotsgesetzes aussen?

Schon jetzt ist es im §3 d. des Verbotsgesetzes verboten, „die Ziele der NSDAP, ihre Einrichtungen oder Maßnahmen zu verherrlichen oder anzupreisen“.

Das Gesetz belässt es aber im unklaren in welchem Umfang das geschen muß damit dieser Tatbestand erfüllt ist und ebenso wird nicht geklärte welche der „Ziele“ alle unter diesen Punkt fällt. In der gängigen Praxis wird die Verbreitung nationalistischer, rassistischer und antisemitischer Ideologie alleine noch nicht unter Strafe gestellt, ansonsten müssten wohl viele Schreibtischtäter schon hinter Gittern sitzen.

Sinnvoll wäre es wohl so etwas wie den Tatbestand der „Nationalsozialistischen Vorfeldorganisation“ einzuführen. z.B.:

„Organisationen die systematisch rassistische, nationalistische, antisemitische Propaganda Verbreiten gelten als Rechtsextreme Organisationen. Diese Organisationen sind von allen öffentlichen Zuwendungen auszuschließen. Insbesndere auch Parteienförderung, Wahlkampfkostenrückerstattung, Presseförderung und der vergabe öffentlicher Aufträge. Unternehmen die regelmäßig oder in signifikantem Umfang solche Rechsextreme Organisationen fördern sind ebenfalls als Rechtsextrem einzustufen.“

Ist das realistisch?

Angesichts der Tatsache dass z.b. die Kronenzeitung mit ihrer Leserbriefseite unter ein solches Verbotsgesetz fallen würde [7] und angesichts der Tatsache dass es auch in der SP und insbesondere in der VP viele sehr weit rechts gerichtete Personen gibt (Schüssel hat ja immerhin gedenkmessen für den Austrofaschismus lesen lassen) ist nicht damit zu rechnen dass die etablierten Parteien ein solches Gesetz beschließen werden. Mit der Kronenzeitung will es sich auch die SP sicher nicht verscherzen. Insofern kann der Impuls für solch ein Gesetz nur von den WählerInnen ausgehen. Machen wir ein Volksbegehren dazu! Das Ende der Sozialdemokratie

Kürzlich fragte mich ein, der SP nahestehender Bekannter: Wie denn das möglich sei: Warum haben die WählerInnen die SP bestraft wo doch die anderen schuld seien an der Krise? Eine Frage die sich vermutlich viele an der sozialdemokratischen Basis stellen.

Ein Teil dieser Frage ist tatsächlich interessant, aber noch interessanter ist, was diese Fragestellung über die Fragenden (und über die SP-Basis) aufzeigt.

Denn allen die kein rotes Parteibuch (mehr) haben ist vermutlich schon lange klar, dass es nicht nur „die anderen“ waren, die „Schuld“ an der Krise sind. Die Sozialdemokratischen Parteien haben in den letzten 20 Jahren eine extrem neoliberalen Kurs gefahren. Die WählerInnen haben das erkannt. Die rest-SP Basis hat das aber anscheinend noch nicht bemerkt. Damit ist aber auch klar dass diese Partei keine Zukunft mehr hat: Es fehlt die innterparteiliche erneuerungskraft: Wer die letzten 20 Jahre nicht bemerkt hat wie der neoliberale Kurs mit roten Nelken ausgeschmückt wurde der wird heute wohl kaum in der Lage sein heute Ideen hervorzubringen wie das Ruder noch herumzureißen sei. Ergo dies Partei ist am Ende.

Mehr als Symbolträchtig in dieser Hinsicht: Am 31. Jänner 2008 schloss die SP ihre „Zukunftswerkstätte“. Das eigentliche Ende der SP begann aber schon 1991 als sich die Partei von „Sozialistischer“ in „Sozialdemokratische“ Partei umbenannte. Damit wurde klar ausgedrückt: Die positive Veränderung der Gesellschaft wurde als nicht weiter notwendig erachtet. Man hatte sich mit dem kapitalistischen System engagiert. Hier und da wollte man/frau noch eine etwas „sozialere“ Note einbringen aber ansonsten gab es am Kapitalismus nichts mehr grundlegendes Auszusetzen.

Dieser Kurs funktionierte eine Zeit lang ganz gut. Solange es den Leuten noch halbwegs gut ging und die Absurdität des Kapitalismus nicht breithin offenkundig wurde.

Womit wir zum berechtigten Teil der Frage kommen: Warum werden fast ausschließlich die Sozialdemokraten für die Krise bestraft? Denn die haben zwar einen deutliche Neoliberalen Kurs gefahren aber sie waren dabei nicht alleine. Die Konservativen Parteien haben waren da ja doch auch nicht ganz unmaßgeblich beteiligt.

Das ist allerdings eine berechtigte Frage. Die Erklärung die ich mir dafür zusammengereimt habe: Die WählerInnen die den Sozialdemokraten jetzt abhangen gekommen sind haben den obigen Widerspruch erkannt. Den Widerspruch zwischen sozialdemokratischer Rhetorik und neoliberaler Realität. Die typische ÖVP WählerInnen hatte auf der anderen Seite noch nie etwas übrig fürs soziale. (Natürlich gibt es auch dort vereinzelt die Propagandalügen von der angeblich so „ökosozialen Marktwirtschaft“ aber im Kern ging es immer schon um die „mehr Privat“ und „weniger Staat“ um so genannte „Leistung“ etc.) Insofern wird von den ÖVP-WählerInnen der Kurs auch nicht als Verrat war genommen.

Vereinfacht könnte man hier also sagen: Die SP hatte die schlaueren WählerInnen. Die haben den Braten gerochen und ihrer Partei die Treue aufgekündigt.

Doch die Krise des Kapitalismus ist noch lange nicht vorbei. Auch wenn es jetzt wieder kurzzeitig bergauf zu gehen scheint. Mit dem von allen so gefeierten „Wirtschaftswachstum“: Damit wird die Fahrt in Richtung Abgrund (Resourcenverknappung, Klimakatastrophen, ... ) letztlich nur Beschleunigt. Weitere große Krisen sind stehen an. Zu hoffen bleibt dabei nur dass die Unzufriedenheit dabei nicht noch weiter nach rechts drängt. Es bedarf jedenfalls einer linken Alternative. Insbesondere in Österreich wo diese noch gänzlich fehlt.

Österreich 2009: Wahlkämpfe mit Hetzplakaten an jeder Straßenecke, gezielte Fehlinformationen durch rechte Parteien und manche Medien, rechtsextreme Burschenschafter in hohen Ämtern und Institutionen, tätliche Angriffe auf KZ-Opfer… alles ganz normal. … Normal??? Ärgern allein hilft nicht.

Daher am 18. Jänner 2009 ab 19:00 Uhr: Lichterkette vor dem Parlament.

Europa hat gewählt

Was als erstes angesichts der EU-Wahl auffällt: Die Ergebnisse werden in Österreich (und scheinbar nicht nur hier) vorwiegend national interpretiert. Was das ganze für die Mehrheitsverhältnisse in der EU bedeutet kommt nur unter „ferner liefen“ vor. Das ist symptomatisch für die kaum vorhandenen Berichterstattung der Medien über die EU-Politik insgesamt.

Laufend werden extrem wichtige Weichenstellungen in der EU getroffen. Anstatt die Bevölkerung von Anfang an (d.h. sobald eine Gesetzesinitative von der Kommsision zum Parlament kommt) detailiert darüber zu informieren wer sie wann und wie wofür einsetzt bekommt man/frau von den meisten Themen wenig bis gar nichts in den Massenmedien zu hören und zu sehen. (Eine löbliche Ausnahme hier stellt die ORF futurezone)

Natürlich kann man/frau sich heute via Internet da und dort entsprechend Informieren. Aber das kostet auch etwas Zeit und die wenigsten haben diese.

Dass also Wahlentscheidungen nicht unbedingt auf rationaler Basis getroffen werden sollte uns nicht verwundern. Wobei dies natürlich auch im Interesse der herrschenden Klasse ist: So lässt es sich sehr bequem Politikwäsche betreiben. Was für die nationale Politik zu heiß ist wird bequem via Brüssel abgewickelt. Falls von den Sauereien die da ablaufen dann irgend etwas bekannt wird kann der entsprechende Groll auf „die böse EU“ abgeleitet werden.

Wir sehen also: Gerade die rechtsextremen und damit nationalistisch orientierten Parteien sind ein extrem wichtiges Element für die Absicherung der neoliberalen Herrschaft. Sie spielen „Blitzableiter“. Anstatt die waren Ursachen für die Probleme zu suchen bieten diese einfache Sündenböcke an ohne an den neoliberalen Dogmen selbst zu rütteln.

Die Auswirkungen der Krise

Die Konservativen gehen EU-weit weitgehend unbeschadet aus der Krise hervor. Angesichts der Verluste der Sozialdemokraten sind sie sogar als einzige große verbleibende Kraft gestärkt. Wie ist das zu erklären? Eine mögliche Antwort: In der Krise suchen die Menschen Halt beim „starken Mann“. Das dürfte auch den Zulauf der rechtsextremen noch etwas in Grenzen gehalten haben. Abgestraft für die Krise wurden dafür die Sozialdemokraten. Nicht zu unrecht denn die haben den neoliberalen Kapitalismus ebenso zu verantworten wie die Konservativen. Offenbar hatten die Sozialdemokraten aber die etwas schlaueren WählerInnen: Die haben den Braten gerochen und sind von ihrer Partei jetzt enttäuscht. Auf der anderen seite: Wer jemals dumm genug war zu meinen dass die Konservativen seine oder ihre Interessen vertritt der ist auch dumm genug das weiterhin zu glauben. (Die 1% Superreichen jetzt mal ausgenommen. Deren Interessen werden ja tatsächlich von diesen so genannten "Volksparteien" vertreten).

So wirklich viel schlauer sind die meisten ex-WählerInnen der Sozialdemokraten allerdings auch nicht. Immerhin sind leider viele zu den rechtsextremen Parteien übergelaufen. Die Linke konnte davon leider nicht profitieren. Immerhin haben aber Grüne und GUE (Linke) zusammen genau so viele Mandate wie zuvor und damit angesichts der geringeren Zahl der Gesamtmandate Europaweit um etwa 7% gewonnen. Zumindest das ist der erfreuliche Teil dieses Wahlergebnisses.

Zerbricht die Sozialdemokratie?

Ein Großteil der Sozialdemokratischen WählerInnen ist den Wahlen offensichtlich fern geblieben. Um diese WählerInnen wird wohl in den kommenden Jahren von verschiedenster seite gekämpft werden. Möglich dass die Sozialdemokratische Partei versucht durch einen sozialeren und kapitalismuskritischeren Kurs diese WählerInnen wieder zurückzugewinnen. Auch möglich dass sie Angesichts des allgemeinen Rechtsrucks auch versuchen weiter nach rechts abzurücken um diese WählerInnenschichten anzusprechen. Vergessen werden darf nicht dass diese Partei ebenso wie die Rechtsparteien zutiefst korrumpiert ist und es daher wohl Kräfte existieren die den neoliberalen Kurs weiterführen wollen und die meinen es müsse nur etwas an der Rhetorik gefeilt werden.

Insgesamt könnte die Sozialdemokratie an diesen Gegensätzen zerbrechen. In jedem Falle ist hier aber Raum für eine neue Linke. Die Linksfraktion hat es aber insegeamt noch nicht geschafft dieses Potential anzusprechen. Kein wunder, ist auch die Performance der Linksfraktion nicht gerade gut. Trotz mehrmalige Anfragen und auch entsprechenden Hilfsangeboten hat es die Linksfraktion z.B. nicht geschafft sich in der wichtigen ACTA Frage mehr zu engagieren. Die Grünen (und insbesondere Eva Lichtenberger) haben hier dagegen Vorbildliches geleistet. Viele der Linksparteien sind leider noch nicht ganz im 21. Jahrhundert angekommen. Wie z.B. auch an der KPÖ zu sehen ist. Hier bedarf es entsprechender Initiativen um diese Lücke zu füllen um den WählerInnen und vor allem den Politischen AktivistInnen eine moderne Linkspartei anbieten zu können.

Früher oder Später werden wohl auch die WählerInnen der Konservativen aufwachen und bemerken dass sie der Neoliberale Kurs an den Rand des Abgrundes gebracht hat oder sogar noch darüber Hinaus. Ob die Krise wirklich überstanden ist ist nicht gesichert. Ebenso möglich wären noch viel tiefgreifendere Erschütterungen. Und früher oder später machen sich wohl auch die vom Kapitalismus sonst noch so verursachten Probleme bemerkbar. Nicht zuletzt steht die Klimakatastrophe vor der Tür.

Hier bedarf es eines Angebotes an die bürgerlichen WählerInnen. Linke Politik die mit bürgerlicher Rhetorik ein Angebot an die, von den Volksparteien losbrechenden WählerInnen. Das wäre eine Aufgabe für die Grünen. Trotz ihrer, z.T. sehr Bürgerlichen Wurzeln machen sie im großen und ganzen eine Durchaus erfreulich linke Politik.

Allerdings ist die breite des Grünen Spektrums beschränkt, das wurde am schlechten Abschneiden der Grünen in Österreich sichtbar: Mit einer zu klar nach Links ausgerichteten Kandidatur haben sie dort ihre bürgerlichen WählerInnen verschreckt. Im erzreaktionären Österreich war das leider zu befürchten. Hier wäre es Hilfreich wenn neben den Grünen eine weitere Politische Kraft vorhanden wäre die sich dezidiert Links positionieren kann ohne auf die Bürgerliche WählerInnen Rücksicht nehmen zu müssen.

Leider ist eine solche Kraft in Österreich nicht vorhanden und so müssen den Grünen dankbar sein, dass sie trotz der Gefahr damit Stimmen zu verlieren, versuchen Linke Inhalte zu transportieren. Nur so ist Veränderung, würden wir uns immer daran orientieren was die kleinformatigen rechten Hetzblätter in Österreich an Politik vorgeben könnte man/frau ja gleich Dichand zum Kaiser krönen. Letztlich ist genau dies die Herausforderung an die Linke:

Die Herausforderungen an die Linke

Linke Alternativen zur kapitalistischen Wirtschaftsordnung müssen glaubhaft vermittelt werden. Neoliberale Denkmuster enttarnt werden. Die Verkürzte Kapitalismuskritik der Rechten und deren Propaganda muss bloßgestellt werden. Nur so ist Veränderung möglich: Wir brauchen einen Paradigmenwechsel. Das ist keine leichte Aufgabe aber auch keine so schwere. Immerhin sind die Lügen der Rechten ja meist recht Absurd.

Gerade in Zeiten der Krise müsste die Linke vor allem auch Geborgenheit vermitteln. Das ist einerseits nicht leicht wenn man/frau gerade die Gesellschaft von Grunde auf umkrempeln will. Hier könnte nur eine Rückbesinnung auf eine radikalen Humanismus helfen:

„Radikal sein ist die Sache an der Wurzel fassen. Die Wurzel für den Menschen ist aber der Mensch selbst. [..] Die Kritik der Religion endet mit der Lehre, daß der Mensch das höchste Wesen für den Menschen sei, also mit dem kategorischen Imperativ, alle Verhältnisse umzuwerfen, in denen der Mensch ein erniedrigtes, ein geknechtetes, ein verlassenes, ein verächtliches Wesen ist.“

D.h.: der Mensch uns seine Probleme müsste deutlicher erkennbar im Mittelpunkt Linker Politik stehen.

Ein Pirat entert das EU-Parlament

Erfreulich ist der Einzug der Schwedischen Piratenpartei ins EU-Parlament. Allerdings: der Pirat will sich entweder der Grünen oder der Liberalen Fraktion anschließen wenn diese im Gegenzug bei den IT Themen auf Seiten der Piraten stimmt. Für die Grünen sollte das kein Problem sein weil sie hier ohnehin fast immer auf der richtigen Seite waren. Bei den Liberalen ist das allerdings nicht so. Die Linksfraktion wäre da eine bessere Wahl. Dort hat man/frau so wie bei den Grünen fast immer vernünftig abgestimmt. Interessant ist es dann warum die Piraten hier dennoch die Liberalen ins Auge fassen. Auch zeigt sich hier das zentrale Problem einer Single-Issue Partei. Kann es den AnhängerInnen der Piratenpartei wirklich völlig egal sein ob ihr Vertreter bei den meisten Abstimmungen einen Grünenn-Linken oder einen Neoliberalen Kurs fährt?

Besser wäre es hier für die Piraten die Fragestellungen rund um IT, so genannte Geistige Eigentumsrechte, Überwachung etc... zu nutzen um die Probleme unserer Gesellschaft zu hinterfragen. Dann wäre es wohl keine Frage mehr wie die Piraten sich zu anderen Themen in der Gesellschaft zu positionieren hätten. Neoliberal käme dann jedenfalls nicht mehr in Frage.

Für die Linksparteien zeigt sollte der Erfolg der schwedischen Piraten jedoch ebenfalls eine Lehre sein: Mit etwas Pfiff und Witz ist es durchaus leicht Proteststimmen einzufangen ohne in die Populismusfalle tappen zu müssen.

Ist der Mensch zu schlecht für den Kapitalismus?

Kapitalismuskritik ist angesichts der aktuellen Finanzkrise in Mode gekommen. Leider beschränkt sich die Kritik meist auf oberflächliche, verkürzte Kritik. Es werden billige Sündenböcke gesucht die für die Misere verantwortlich gemacht werden können. Diese Art von Kritik ist nicht nur wenig hilfreich sondern sogar extrem gefährlich.

Das dumme Gerede von der angeblichen „Gier“

Besonders verbreitet ist heute die moralisierende Kapitalismuskritik: Die „Gier“ der Manager sei Schuld am Problem. Dies wird meist kombiniert mit einem Verweis auf deren extrem hohen Gehälter.

Angesichts solcher „Analysen“ muss die provokante Frage aufgestellt werden: Ist der Mensch zu schlecht für den Kapitalismus? Genau das ist ja dem Kommunismus immer wieder vorgeworfen worden: Er wäre ja eine nette Idee aber stünde im Widerspruch zu der, als schlecht vorausgesetzten,Natur des Menschen.

Ist natürlich beides himmelschreiender Unsinn. Profite zu machen ist (oft sogar gesetzlich Verankerte) Pflicht von Unternehmen. Wer als UnternehmensleiterIn von den AktonärInnen bestellt werden will muss sich jedenfalls diesem Ziel verschreiben. Dafür wird er oder sie dann bezahlt. Es ist ein Job wie jeder andere. Von Börsenbroker bis zum Hauswart arbeiten wir alle in dieser Maschinerie mit und tun wofür wir bezahlt werden.

Die Gefahr wenn die Kritik am Kapitalismus auf eine moralische Ebene verlagert wird (und genau das passiert wenn wir von so genannter „Gier“ gesprochen wird) ist, dass dabei das System aus dem Blickfeld gerät und plötzlich einzelne Menschen als Sündenböcke dastehen. Die Folge: Repression zur Durchsetzung der moralischen Standards und im schlimmsten Falle die physische Vernichtung aller jener die sich nicht unterordnen wollen oder denen eine Unterordunung nicht zugetraut wird. Auschwitz sollte hier ein deutliches Mahnmal sein. Dem dummen Gerede von der „Gier“ muss entschieden entgegengetreten werden.

Kapitalismus funktioniert nicht

Und das sagen nicht nur unbelehrbare Altkommunisten sondern so denkt ganz offensichtlicht auch die EU-Kommission.

Immerhin greift sie ja sehr oft und sehr intensiv in den freien Markt ein: Z.b: Glühbirnenverordnung: Obwohl Energiesparlampen auf Dauer offensichtlich deutlich billiger sind als alte Glühlbirnen sah sich die EU-Kommission genötigt diese zu verbieten. Wo bleibt da die angeblich so gut funktionierende freie Marktwirtschaft wenn sogar solch winzige Details geregelt werden müssen? Detto mit Handyroaminggebühren & co. etc..

Im Zuge der unsäglichen „Gier“-Debatte wird darüber nachgedacht ManagerInnengehälter zu limitieren. Wo bitte bleibt da die freie Marktwirtschaft? Und wenn sie bei all diesen Detailfragen offensichtlich nicht funktioniert warum soll sie dann überhaupt irgendwo funktionieren?

Wobei angesichts der Tatsache, dass der Kapitalismus dort wo er „funktioniert“ noch größeren Schaden anrichtet (siehe: Die sieben Probleme mit dem Kapitalismus) es oft gar nicht so schlecht ist wenn er wo nicht funktioniert...

Diese System produziert periodische Krisen, Ungleichverteilung, Hunger, Kriege, 10 Millionen Tote/Jahr, Umweltzerstörung und Klimakatastrophen. Dass es dazu eine bessere Alternative geben muss ist einsichtig. Dass wir es auch noch weit schlechter anstellen können sollte aus der Geschichte ebenfalls bekannt sein.

Die verkürzte, moralisierende und antisemitische Kapitalismuskritik entsteht dabei nicht immer bloß aus Dummheit sondern auch aus dem Wunsch weitermachen zu können wie bis jetzt.

Aus diesem Wunsch speist sich auch

das Gerede von der „Sozialen Marktwirtschaft“

Bei diesem Begriff handelte es sich immer schon um einen PR-Begriff aus der Mottenkiste der neoliberalen IdeologInnen.

Marktwirtschaft ist nicht sozial. Die 10 Millionen Menschen die Jährlich verhungern verhungern nicht deswegen weil es zu wenig Nahrung gibt sondern weil sie in dieser Marktwirtschaft weder als Konsumenten nicht gebraucht werden.

Marktwirtschaft funktioniert nur bei Mangel (wer würde am Strand schon Sand verkaufen?) und dort wo kein Mangel herrscht dort trachtet der Kapitalismus danach diesen herzustellen. Darum auch der massive Ausbau der so gennannten geistigen Eigentumsrechte. Seit die Kids ihre Musik kostenlos übers Netz tauschen können besteht kein Mangel mehr an Musik.

Das Gerede von der „Sozialen Marktwirtschaft“ ist also bloß eine Neuauflage der selben Lügen. Wenn aber Marktwirtschaft von sich aus nicht sozial ist was stellen sich diejenigen die sie propagieren denn darunter vor? An dieser Stelle find das Gerede von der „Sozialen Marktwirtschaft“ oft Anschluss zum Gerede über die angebliche „Gier“. Was die angeblich „soziale Marktwirtschaft“ von der „normalen“ Marktwirtschaft unterscheiden soll ist eben eine „moralische Erneuerung“, ein „Verzicht“ auf „Gier“, etc..
